Off-Road Vehicles on Private Property

John Graham, Code Enforcement Officer, City of Miamisburg, 937-847-6540, john.graham@cityofmiamisburg.com

would like to hear from any municipalities which regulate or restrict the use of off-road RV’s such as trail bikes, 4-runners, etc., on private property. The only thing we now have is a requirement that they have the owner’s permission to do so, and must have a headlight & taillight if they are used after dusk.

As far as I know Moraine has no ordinance on this issue as long as they have the owner’s permission regardless of location. Case in point a few months back there was a compliant of dirt bikes riding in the yard of a vacant house in a standard R-2 neighborhood. The city is cutting the grass on this property yet the police said there was nothing they could do because the riders said the owner gave them permission to ride on the lot (the owner is dead & if he is giving permission how about permission for them to cut the grass). The police waited till the riders entered the street then cited them for no licenses.

Long story short no we don’t but we do need one and I had to vent a little.

The only restriction we have revolves around the noise issue. Our Police Dept. enforces the ordinance. We do enforce, however, the condition of the property grounds such as trash, junk and crappy out buildings under our maintenance code. Hope this helps. Mike Saracina, Code Enforcement Officer
